TERMS OF SERVICE
These Terms of Service govern the use of the NeoPop website and all purchases made through it.
By accessing this website or placing an order with NeoPop, you agree to these Terms of Service together with our Return & Refund Policy, Shipping Policy and Privacy Policy.

2. Our Jewellery
NeoPop creates and sells handmade jewellery, including necklaces, earrings, bracelets, charms and related pieces.
Many NeoPop pieces are one of a kind.
Our jewellery may incorporate semi-precious stones, natural stones, shells, beads, African trade beads and other handmade or naturally occurring materials.
Variations in colour, shape, texture, markings and size are inherent characteristics of these materials and of handmade jewellery and are not, by themselves, defects.
3. Product Images & Descriptions
NeoPop makes every reasonable effort to represent products accurately.
Because jewellery is photographed under particular lighting conditions and displayed on different screens and devices, actual colours may vary slightly from those shown online.
Measurements are approximate unless expressly stated otherwise.
Due to the one-of-a-kind nature of many pieces, the item supplied will be the particular piece purchased where the listing identifies it as an individual piece.
4. Availability & One-of-a-Kind Pieces
Placing an item in your shopping cart does not reserve the item.
An order is subject to successful payment and acceptance by NeoPop.
Because many products are unique, an item may only be available once.
In the unlikely event that an item becomes unavailable after an order has been placed, NeoPop will contact the customer and, where payment has already been received for an item that cannot be supplied, refund the amount paid for that item.
5. Orders
NeoPop reserves the right, where reasonably justified and permitted by law, to decline or cancel an order, including where:
- Payment has not been successfully completed;
- An item is unavailable;
- There is an obvious pricing or product-listing error;
- Fraudulent or unauthorised activity is reasonably suspected; or
- The order cannot lawfully be fulfilled.
Where NeoPop cancels an order after receiving payment and the customer is entitled to repayment, the relevant amount will be refunded.
6. Prices & Payment
Prices are displayed in the currency indicated on the website.
Applicable delivery charges and other charges payable to NeoPop will be displayed during checkout before the order is completed.
Payment must be made using one of the payment methods offered at checkout.
NeoPop reserves the right to correct genuine pricing, typographical or product-description errors.
Where an error materially affects an order already placed, NeoPop will contact the customer before proceeding.
7. Returns, Exchanges & Refunds
Purchases are subject to NeoPop’s separate Return & Refund Policy.
Because many NeoPop products are handmade and one of a kind, NeoPop does not voluntarily offer cash refunds for ordinary change of mind except where NeoPop expressly agrees otherwise or where a refund or cancellation right is required by law.
Earrings are subject to the specific hygiene-related provisions contained in our Return & Refund Policy.
Nothing in these Terms limits or excludes a consumer right or remedy that cannot lawfully be limited or excluded.
8. Delivery
Orders are delivered in accordance with our separate Shipping Policy.
Delivery dates and times provided by NeoPop or a courier are estimates unless expressly agreed otherwise.
International orders may be subject to customs duties, import taxes and other charges imposed by the destination country. Responsibility for such charges will be dealt with in accordance with our Shipping Policy and applicable law.
9. Jewellery Care
NeoPop jewellery must be treated with reasonable care.
Unless expressly stated otherwise, jewellery should not be exposed unnecessarily to perfume, cosmetics, chemicals, chlorine, seawater or excessive moisture.
Normal wear and tear, accidental damage, misuse, improper storage or damage resulting from inappropriate handling is not considered a manufacturing defect merely because it occurs after purchase.
Nothing in this clause limits any statutory rights relating to defective goods.
10. Intellectual Property
Unless otherwise stated, the NeoPop name, branding, logo, jewellery designs, photographs, graphics, artwork, written content and other original material appearing on this website belong to Neogroup CC trading as NeoPop or are used with permission.
Such material may not be reproduced, copied, commercially exploited, distributed or used to create derivative commercial products without prior written permission from NeoPop, except where otherwise permitted by law.
11. Acceptable Website Use
The NeoPop website may be used for lawful personal shopping and informational purposes.
Users may not knowingly:
- Interfere with the operation or security of the website;
- Attempt unauthorised access to the website or its systems;
- Introduce viruses, malicious code or other harmful material;
- Use the website for fraudulent or unlawful activity; or
- Reproduce or commercially exploit protected NeoPop content without permission.
12. Privacy & Personal Information
NeoPop processes personal information in accordance with its Privacy Policy and applicable South African law.
Information required to process an order may be shared with service providers where reasonably necessary for payment processing, order fulfilment, delivery and other legitimate business purposes, subject to applicable privacy requirements.
13. Third-Party Services
The NeoPop website may use third-party services including payment providers, courier services and technology providers.
Where customers use services provided directly by third parties, those services may also be subject to the relevant third party’s terms and privacy practices.
14. Liability
NeoPop does not exclude or limit liability where doing so would be prohibited by applicable law.
To the extent permitted by law, NeoPop will not be responsible for indirect or consequential loss arising from circumstances beyond its reasonable control or from misuse of its products.
Nothing in these Terms excludes liability for gross negligence or removes any right or remedy that a consumer is entitled to under applicable South African law.
15. South African Consumer Law
These Terms must be read subject to applicable South African consumer-protection legislation, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002.
Nothing in these Terms is intended to waive, restrict or exclude any statutory right that cannot legally be waived, restricted or excluded.
If any provision of these Terms conflicts with a mandatory provision of applicable law, the mandatory provision will prevail.
16. Governing Law
These Terms of Service and transactions concluded through the NeoPop website are governed by the laws of the Republic of South Africa.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be applied to the maximum extent permitted by law and the remaining provisions will continue to apply.
18. Changes to These Terms
NeoPop may amend these Terms from time to time.
The terms applicable to a purchase will be those in effect when the relevant order is placed, subject to applicable law.
